    E-COMMERCE RETURN AND REFUND POLICY

    At Harley Butler Trading Company, LLC (“Harley Butler”), we want you to be completely satisfied with your purchase. If, however, you choose to return some or all of your order, there are some important points to know.

    As an e-commerce business, Harley Butler ships orders using various carriers (“Carriers”), including USPS, FedEx and UPS for smaller items, and Common Carriers, specialized delivery services, and manufacturer’s warehouse delivery for large and bulky furniture orders. It is your responsibility, as the Purchaser, to inspect your delivery from Harley Butler upon receipt for any damages in transit. As there are certain steps which need to be taken by you, the Purchaser, for any damage claims, please refer to the “Damaged Items Claims Process” below.

    UNDAMAGED ITEMS RETURNED FOR REFUND OR EXCHANGE

    Our General Policy is as follows below. There are some items, however, which we offer from time to time for which our supplier has more restrictive requirements, or periods in which, to return those specific items. In those specific instances, the time period in which to make a return and conditions therein will prevail over our General Policy. The specific requirements, where applicable, are included as “SPECIFIC TO THIS ITEM:” on the Shipping & Returns tab for that item. It is your responsibility to be aware of these specific limitations at the time of purchase and to abide by that specific product return policy should you choose to make a return.

    We only offer a return or exchange once per original order.

    You, the Purchaser, may decide to return some or all of your order from Harley Butler for store credit, refund, or exchange for undamaged items that are:

    • Not as you expected
    • Wrong size was received
    • Wrong color was received
    • Wrong item(s) was(were) received

    Harley Butler reserves the right to make sales final at the time of purchase, including but not limited to:

    • Manufacturer or Supplier closeout
    • One-of-a-kind items
    • Clearance or Sale items
    • Personalized or customized items, custom or special orders
    • Items you have already assembled
    • Gift cards
    • Food products
    • Items of a personal or intimate nature, including but not limited to swimwear, face coverings, intimate wear, lingerie, or like items
    • Bundled items, Buy “X” Get “Y” type items, or other items discounted when purchased in multiples, unless the ENTIRE bundle is exchanged or returned
    • Items marked “Non-Returnable,” “No Return,” “All Sales Final,” or any other related descriptive wording
    • Other items identified on the product description page, in our sole discretion.

    You have 14 (fourteen) calendar days from the date of delivery receipt to initiate a return or exchange and request a Return Authorization. Harley Butler will not honor requests for returns or exchanges after 11:59 P.M. CDT (CDST) 14 (fourteen) calendar days from date of delivery receipt, as evidenced by the Carrier’s delivery documentation, and all sales at that time will be final. If the final day to register a refund or exchange request falls on a weekend or holiday, the next business day will be considered the final day. Approved refunds will be made to the original payment source.

    You may choose to exchange the item with another. We will invoice you for the difference if the value is greater than the original item, or you may receive store credit or Harley Butler Gift Cards or a refund for the difference if less than the original item, including adjustment for sales tax, as applicable. The original item being exchanged must be received, inspected for any damage, and accepted by Harley Butler prior to the exchange item being delivered. The sale will be considered final and no further refunds or exchanges can be made.

    Our preferred method for returns is to issue you a store credit for the original purchase price of the item(s) being returned plus net sales tax, if any, but not the delivery charge. As an incentive to selecting this method in the situation that you have changed your mind about the purchase, we will only impose a restocking fee equal to 10% (ten percent) of the original purchase price of the item(s), which will be deducted from the store credit being extended. No restocking fee is imposed in situations where the item received was not that as originally ordered (e.g., wrong size, color, or a different item).

    If you opt for a return and refund in the situation that you have changed your mind about the purchase, the refund will be made for the original purchase price of the item(s) plus net sales tax, if any, but not the delivery charge. In addition, a restocking fee equal to 20% (twenty percent) of the original purchase price of the item(s) will be incurred and deducted from the refund. No restocking fee is imposed in situations where the item received was not that as originally ordered (e.g., wrong size, color, or a different item).

    You, the Purchaser, are responsible for return shipping costs, and the item must be in its original and unused condition and packaging to be accepted. We strongly recommend sufficient insurance is provided by the Carrier, purchased at your own expense, to cover the return as there will be no refund or exchange for items that are received damaged. For items shipped via Common Carrier, we will be glad to assist you with arranging return shipping, at your expense, as there are certain Carriers better suited for the type of merchandise we sell. If you select an unapproved Carrier, you do so at your own risk and expense.

    DAMAGED ITEMS CLAIMS PROCESS

    Our General Policy is as follows below. It is your responsibility to be aware of these specific limitations at the time of purchase and to abide by that specific product return policy should you choose to make a return.

    If shipping damage is observed upon delivery of your order, do not accept delivery and notify the Carrier before the driver leaves your property, noting the damage on the delivery ticket. You, the Purchaser, should retain a copy of the delivery ticket with the damage noted thereon. If shipping damage is observed after the Carrier’s driver leaves your property, contact Harley Butler immediately, but no later than 4 (four) days from date of delivery. Our Carriers have specific freight damage claims processes which must be observed to preserve your and Harley Butler’s rights for refund or exchange. Harley Butler will work with the Carrier to arrange an exchange for the shipping damaged item(s) to minimize your inconvenience.

    EFFECTIVE DATE AND UPDATES

    The effective date of this E-Commerce Return and Refund Policy (“Refund Policy”) is April 28, 2020. You agree that Harley Butler may modify and amend the Refund Policy at any time in its sole discretion and without notice to you. When it is modified and amended, the modified and amended Refund Policy will be made available on the Harley Butler website for your convenience, and your continued use of the Harley Butler Site and Services, as incorporated by reference with the Terms of Use, will constitute your acceptance of any modified terms in this Refund Policy.
